Terms & Conditions govern the use of the Vesna Djilas Photography
website and the purchase of goods from it.
Acknowledgment
and acceptance of Terms & Conditions
Please note that by accessing, using or browsing this website you
agree to be bound by its terms, conditions, disclaimers and limitations
of liability (“Terms & Conditions”).
Vesna
Djilas Photography reserves the right to amend or update the Terms
& Conditions at any time without providing notice to you. By
using the website, you acknowledge that you have read and understood
these Terms & Conditions.
Disclaimer
The information contained on the website is provided by Vesna Djilas
Photography in good faith. To the best of Vesna Djilas Photography’s
knowledge, the information is accurate and current. However, Vesna
Djilas Photography does not make any representation or warranty
as to the currency, accuracy or completeness of the information.
Limitation
of Liability
To the maximum extent permitted by law but subject to any non-excludable
liability for breach of conditions or warranties implied by legislation,
any liability of Vesna Djilas Photography relating to goods or services
supplied to you via this website will be limited to:
1. in relation to goods, the replacement of the goods or the payment
of the cost of replacing the goods; and
2. in relation to services, the re-supply of the services or the
payment of the cost of re-supplying the services.
Applicable
Law
These Terms & Conditions are governed by the laws in force in
Victoria, Australia and you irrevocably and unconditionally submit
to the non-exclusive jurisdiction of the courts of Victoria, Australia
and any courts, which may hear appeals from those courts.
Children
It is important that any information provided or purchase made by
children has the consent of parents or guardians.
Placing
and Accepting Orders
Placement of an order by you constitutes an offer to enter into
an agreement with us (“your offer”). We will e-mail
you an order confirmation for the sole purpose of confirming the
details of your offer. Our order confirmation does not constitute
an acceptance of your offer or reflect the status of your order
in any way.
Artwork
remains the property of Vesna Djilas Photography until the full
payment is received. Orders will not be dispatched until Vesna Djilas
Photography is satisfied with the integrity of the order and payment
has been received in full.
Other
Editions
Vesna Djilas Photography is entitled to sell artworks and images
to other parties in such editions, numbers and sizes at our discretion.
Delivery
It is your obligation to enter the correct delivery address details
at the time of ordering. Should you have given us the wrong address,
we are not obliged to re-send the order to the correct address at
our expense.
All
parcels are mailed and delivery is estimated to be within 28 days
after payment is processed. We will advise you should any delay
to this usual period become foreseeable.
It
is the responsibility of the customer to inform Vesna Djilas Photography
if an order does not arrive. Once we learn an order has not arrived
within the usual period, we will make enquiries to ensure delivery
occurs as soon as possible.
We
will not be held liable for any loss or damage resulting from a
late delivery. Without limiting the operation of any other Terms
& Conditions herein, you agree that late delivery does not constitute
a failure of our agreement, and does not entitle you to cancel an
order.
If
an item has been lost in transit, we will not dispatch a replacement
item immediately. Replacement items will be dispatched at our discretion.
Cancellation
by Us
We reserve the right not to provide goods or services or cancel
orders (or part thereof) at our sole discretion at any time. Without
limiting the operation of any Terms & Conditions, we will not
be held liable for loss or damage caused by exercising these rights.
Cancellation
by You
If you need to cancel an order, please contact us immediately on
(+61 3) 8361 6133. Our agreement with you only comes into existence
once we have both confirmed your order and your payment has been
processed. Once we have accepted payment for an order, cancellation
of the order is within our sole discretion.
Goods
Damaged or Faulty on Delivery
Except as required by law, you must return, at Vesna Djilas Photography’s
reasonable expense, damaged or faulty goods in the same condition
as they were received within 14 days of receipt.
In the event that you receive a damaged or faulty product, we will
refund the original product price via the original method of payment.
Alternatively, if you request a replacement, we will dispatch your
replacement item (subject to availability) once we receive the return,
at our cost.
Please
note that all products that are found not to be damaged or faulty
will incur the delivery costs of returning the item to Vesna Djilas
Photography.
Liability
Without limiting the operation of any other Terms & Conditions,
Vesna Djilas Photography is not responsible for any loss or damage
arising from late delivery or cancellation of an order or from items
lost, stolen or damaged after delivery has taken place.
Copyright
& Ownership
Vesna Djilas Photography owns copyright of all images, content and
intellectual property in the Vesna Djilas Photography website. You
are not permitted to take copyright interest, reproduce, publish
or distribute any images or content of this website.
